General Privacy Policy Introduction

Johnson Outdoors Inc. and its subsidiaries and affiliates (the "Companies") respect individual privacy and value the confidence of their employees, customers, business partners and others. The Companies strive to collect, use and disclose personal information in a manner consistent with the laws of the countries in which they do business, and pride themselves on upholding the highest ethical standards in their business practices. This Privacy Policy (this "Policy") sets forth the privacy principles that the Companies follow with respect to personal information transferred from the European Union (the "EU") to the United States, and all other personally identifiable information received by the Companies from employees, customers and consumers whether from the EU or elsewhere.

Safe Harbor

The United States Department of Commerce and the European Commission have agreed on a set of data protection principles and frequently asked questions (the "Safe Harbor Principles") to enable U.S. companies to satisfy the requirement under European Union law that "adequate" protection be given to personal information transferred from the EU to the United States. Consistent with its commitment to protect personal privacy, the Companies adhere to the Safe Harbor Principles.

On October 6, 2015, the Court Justice of the European Union invalidated the Safe Harbor Agreement, however Johnson Outdoors and its subsidiaries and affiliates have made a commitment to continue to comply with the privacy principles explained below. The Companies will continue to monitor developments on this issue and will update this policy if necessary.

Scope

This Policy applies to all personal information received by the Companies in the United States from the EU or elsewhere, in any format including electronic, paper or verbal. "Personal information" means any information or set of information that identifies or is used by or on behalf of the Companies to identify an individual. Personal information does not include information that is encoded or anonymized, or publicly available information that has not been combined with non-public personal information. "Sensitive personal information" means personal information that reveals race, ethnic origin, sexual orientation, political opinions, religious or philosophical beliefs, or trade union membership, or that concerns an individual's health. In addition, the Companies will treat as sensitive personal information any information received from a third party where that third party treats and identifies the information as sensitive.

Privacy Principles

The privacy principles in this Policy are based on the Safe Harbor Principles, and are as follows:

  1. Notice. Where the Companies collect personal information directly from individuals in the EU or elsewhere, they will inform them about the type of personal information collected, the purposes for which they collect and use the personal information, and the types of non-Agent third parties to which the Companies disclose or may disclose that information, and the choices and means, if any, the Companies offer individuals for limiting the use and disclosure of their personal information. "Agent" means any third party that collects or uses personal information under the instructions of, and solely for, the Companies or to which the Companies disclose personal information for use on their behalf. Notice will be provided in clear and conspicuous language when individuals are first asked to provide personal information to the Companies, or as soon as practicable thereafter, and in any event before the Companies use or disclose the information for a purpose other than that for which it was originally collected. Where the Companies receive personal information from their subsidiaries, affiliates or other entities in the EU or elsewhere, they will use and disclose such information in accordance with the notices provided by such entities and the choices made by the individuals to whom such personal information relates.

  2. Choice. The Companies will offer individuals the opportunity to choose ("opt-out") whether their personal information is: (a) to be disclosed to a non-Agent third party, or (b) to be used for a purpose other than the purpose for which it was originally collected or subsequently authorized by the individual. For sensitive personal information, the Companies will give individuals the opportunity to affirmatively and explicitly ("opt-in") consent to the disclosure of the information to a non-Agent third party or the use of the information for a purpose other than the purpose for which it was originally collected or subsequently authorized by the individual. The Companies will provide individuals with reasonable mechanisms to exercise their choices.

  3. Data Integrity. The Companies will use personal information only in ways that are compatible with the purposes for which it was collected or subsequently authorized by the individual. The Companies will take reasonable steps to ensure that personal information is relevant to its intended use, accurate, complete and current.

  4. Onward Transfer. The Companies will obtain assurances from their Agents that they will safeguard personal information consistently with this Policy. Examples of appropriate assurances that may be provided by Agents include: a contract obligating the Agent to provide at least the same level of protection as is required by the relevant Safe Harbor Principles, being subject to EU Directive 95/46/EC (the EU Data Protection Directive), Safe Harbor certification by the Agent, or being subject to another European Commission adequacy finding. Where the Companies become aware that an Agent is using or disclosing personal information in a manner contrary to this Policy, the Companies will take reasonable steps to prevent or stop such use or disclosure.

  5. Access and Correction. Upon request, the Companies will grant individuals reasonable access to personal information that it holds about them. In addition, the Companies will take reasonable steps to permit individuals to correct, amend, or delete information that is demonstrated to be inaccurate or incomplete.

  6. Security. The Companies will take reasonable precautions to protect personal information in its possession from loss, misuse and unauthorized access, disclosure, alteration and destruction.

  7. Enforcement. The Companies will conduct compliance audits of their relevant privacy practices to verify adherence to this Policy. Any employee that the Companies determine is in violation of this policy will be subject to disciplinary action up to and including termination of employment.

  8. Dispute Resolution. Any questions or concerns regarding the use or disclosure of personal information should be directed to the contact person identified in section 7 below. The Companies will investigate and attempt to resolve complaints and disputes regarding use and disclosure of personal information in accordance with the principles contained in this Policy. For complaints that cannot be internally resolved between the Companies and the complainant, the Companies have agreed to: (i) for all disputes relating to human resources and one or more employees located in the EU, participate in the dispute resolution procedures of the panel established by the European data protection authorities to resolve disputes pursuant to the Safe Harbor Principles and (ii) resolve all other disputes through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its International Arbitration Rules. Arbitration pursuant to (ii) of the preceding sentence shall be conducted by a single, neutral arbitrator selected by mutual agreement of the parties or, if the parties cannot reach an agreement, by AAA under its standard selection procedures. Such arbitration shall take place in Milwaukee, Wisconsin, United States of America, or such other place as mutually agreed by the parties.

Limitation on Application of Principles

Adherence by the Companies to these Safe Harbor Principles may be limited: (a) to the extent required to respond to a legal or ethical obligation and (b) to the extent expressly permitted by an applicable law, rule or regulation.

Amendments

This Policy may be amended from time to time, consistent with the requirements of the Safe Harbor Principles. A notice will be posted on the Companies' web pages for 60 days whenever this Policy is materially changed.

This privacy policy identifies the type of information Johnson Outdoors, its affiliates and subsidiaries (collectively, "Johnson Outdoors"), collects from its customers and how Johnson Outdoors uses this information. Your use of this website may also be governed by other terms and conditions contained on separate user agreements. Use of Customer Information

Johnson Outdoors respects the privacy of its customers and takes steps to prevent unauthorized disclosure of customer information to third parties. Customer information includes any and all information received by Johnson Outdoors from its customers, whether such information is received by email, online forms, telephone, facsimile, mail or otherwise. Johnson Outdoors stores this information to enable it to fulfill orders or to improve the level of service to its Customers. Johnson Outdoors also shares certain personal and/or financial information with its merchant account and banking vendors to process orders and payments and with common carriers to ship products to you. Unless required by law or by court order, Johnson Outdoors will not disclose, share or sell any customer information to any other third party without your prior authorization. Unless otherwise stated, this privacy policy does not apply to information posted by users to publicly accessible portions of our websites, including but not limited to, online forums, bulletin boards, dealer listings or online auction services.

Personal and Financial Information Collected by Johnson Outdoors

Throughout our websites there are forms that request information from you and/or allow you to purchase products and services. These forms typically ask for contact information (such as name, mailing address and email address), membership, login and password information and financial information (such as credit card number, expiration date and verification code) required to process your order and ship products to you. Johnson Outdoors will collect similar information when processing orders via telephone. The provision of such information by you is entirely voluntary. If you elect or opt in to receive information from us, we will ask for a valid email address and telephone number so we can inform you of other products or services available or to contact you about your opinion of current products and services or potential new products and services that may be offered. You may opt out of receiving future mailings from Johnson Outdoors by following the procedures detailed in the Choice/Opt Out section located below, on forms located on our website or in emails you receive from us. You may also request that we delete any personal information from our customer databases at any time by contacting Johnson Outdoors. In certain cases, Johnson Outdoors, may forward purchasing and shipping information to vendors who ship products or provide services directly to consumers. Such third party vendors and suppliers are not bound by this privacy policy.

IP Address Logging

Johnson Outdoors' web servers collect domain names and/or IP addresses of users to measure what pages and features are accessed by our visitors. Johnson Outdoors uses software such as Web Trends to collect and analyze this information. This information helps us administer the site, improve content and gather broad demographic information for aggregate use. Johnson Outdoors links IP addresses to personally identifiable information submitted to Johnson Outdoors. This information is used to verify whether a visitor has opted in to receiving additional information from Johnson Outdoors.

Cookies

Johnson Outdoors may use cookies or similar files or scripts throughout its website to enhance your convenience in using our websites, to improve search functionality or to hold information that you would otherwise need to re-key. Cookies are text files collected by a user's web browser. If you do not wish to accept cookies from our website, you may configure your web browser so that it does not accept cookies; however, you may lose certain functions available on our website. Johnson Outdoors also uses one or more companies to place advertisements for our products and services and those of third parties on our Site and third-party sites.  Cookies and other technologies such as Web beacons or tags are used to measure the effectiveness of our ads and to determine the display of content and advertising to you based on your interests both on our site , as well as on third-party sites where you may visit.  To support this interest based advertising solution, we, and companies who we have contracted with, may use anonymous information about your visits to our and other Web sites. The information collected and used by this process is always anonymous, and does not enable any third-party to identify you individually. Although it is our hope that you find the display of advertising to you based on your anonymous interests valuable, if you would prefer not to participate in the services offered through these solutions, you can always opt-out of this activity by visiting the Network Advertising Initiative (NAI) website by clicking http://www.networkadvertising.org/managing/opt_out.asp.

Johnson Outdoors is not responsible for the privacy practices or the content of such other sites. By including links to other websites, we neither endorse such sites nor guarantee that the information they contain is accurate. We encourage you to be aware when you leave our site to read the privacy statements of every linked website as the privacy policies of each may differ from ours. This privacy statement applies solely to websites owned or operated by Johnson Outdoors.

Monitoring

Johnson Outdoors is under no obligation to monitor the conduct of its website users, but it may investigate and respond if violations are reported. Johnson Outdoors reserves the right to delete, remove or exclude any listing or information, in its sole discretion, that does not meet its intent and guidelines for the services offered on the website.

Changes to Privacy Policy

In the future, Johnson Outdoors may offer new and different programs that necessitate a change in this Policy. Johnson Outdoors reserves the right to change its privacy policy at any time without prior notice. Any changes to the privacy policy will be posted on this page and will be effective immediately upon posting.

Governing Law and Jurisdiction

This Policy, and Johnson Outdoors' collection and use of customer information, shall be governed and interpreted in accordance with the laws of the United States and the state of Wisconsin. Any disputes arising out of this Policy shall be adjudicated in a court of competent jurisdiction in the Eastern District of the state of Wisconsin.

Governing Language

Any translation of this Policy is done for local requirements and in the event of a dispute between the English and any non-English versions, the English version of this License Agreement shall govern.

Security

We are committed to preventing others from unauthorized access to the personal information you provide to us, and we maintain commercially reasonable procedures and technology designed for this purpose. This website has reasonable technical and organizational security measures in place to protect the loss, misuse or alteration of information under our control. However, we cannot guarantee that unauthorized third parties will never be able to defeat those security measures. Although we cannot guarantee that our systems are 100% secure 100% of the time, we periodically update and test our technology in order to improve the protection of customer information. 

We suggest that you install anti-virus software on your computer and routinely check for viruses, keyloggers, spyware and other programs that may become installed on your computer without your permission. If you believe that you have received a virus from Johnson Outdoors, please contact us as soon as possible so that we may take remedial measures to remove the virus. 

Johnson Outdoors does not send emails to customers requesting billing, login or password information. If you receive an email purporting to be from Johnson Outdoors that asks you to provide personal or account information, or login and passwords, do not provide such information unless you have first verified that the website or email is from Johnson Outdoors. Such emails may be fraudulent and used in connection with scams known as phishing. Johnson Outdoors asks that you report any suspicious emails or websites to Johnson Outdoors.
